Terms of Service

These Terms of Service ("Terms") govern your use of eMarketingAI ("we", "us", "the Service"), available at https://emarketingai.pl. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

eMarketingAI is an AI-assisted marketing platform. It lets you plan, create, schedule and publish marketing content, connect third-party accounts (social networks, search, app stores, email) and review the resulting analytics in one place. Features and plan limits may change as the Service evolves.

You retain ownership of the content you create, upload or import into the Service. You grant us a limited licence to store, process and transmit that content solely to operate the Service for you — for example to publish a post to a connected account on your instruction, or to generate an AI suggestion you requested. We do not sell your content and we do not use it to advertise to third parties.

You are responsible for holding the rights to everything you publish through the Service, including images, video, music and trademarks.

4. Connected third-party accounts

The Service can connect to accounts you own on third-party platforms (for example TikTok, Instagram, Facebook, LinkedIn, Telegram, Google Search Console, Google Play). When you connect an account:

The Service uses AI models to generate text, images and recommendations at your request. AI output can be inaccurate, outdated or unsuitable for your context. You are responsible for reviewing anything generated before publishing it, and for ensuring it complies with applicable law and the rules of the platform you publish to.

We work to keep the Service available and reliable, but it is provided "as is" and "as available", without warranties of any kind. Scheduled maintenance, third-party outages and changes to platform APIs may interrupt functionality.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, lost profits, lost revenue or lost data arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months preceding the claim.

10. Suspension and termination

You may stop using the Service and delete your account at any time; see our data deletion instructions. We may suspend or terminate access if you materially breach these Terms, if required by law, or if your use threatens the security or integrity of the Service. Where practical we will notify you first.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, communicated to you. Continuing to use the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Mandatory consumer-protection rights available to you under the law of your country of residence are not affected.
